1. Acceptance of Terms

By accessing or using ChamaPlatform ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ChamaPlatform provides a WhatsApp-based Chama (investment group) management platform that integrates with M-PESA for contribution tracking and payment processing. The Service includes member management, contribution tracking, automated reminders, and financial reporting.

3. User Accounts

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account
  • You must be at least 18 years old to use the Service
  • One person may not maintain more than one account

4. Subscription Plans & Payments

ChamaPlatform offers free and paid subscription plans. Paid plans are billed monthly via M-PESA. Subscriptions auto-renew unless cancelled. Refunds are available within 7 days of payment for unused services.

5. M-PESA Transactions

ChamaPlatform facilitates M-PESA transactions between Chama members. We are not a financial institution. All M-PESA transactions are processed by Safaricom and subject to Safaricom's terms and conditions. ChamaPlatform is not liable for failed, delayed, or incorrect M-PESA transactions.

6. Acceptable Use

You may not:

  • Use the Service for money laundering or illegal activities
  • Impersonate other users or Chama members
  • Attempt to access other users' accounts
  • Use the Service to send spam or unsolicited messages
  • Reverse engineer or attempt to extract source code

7. Limitation of Liability

ChamaPlatform provides the Service "as is" without warranties. We are not liable for disputes between Chama members, financial losses from group activities, or interruptions to the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Disputes shall be resolved through arbitration in Nairobi, Kenya.
